Locked in a toilet by 10-year-old tormentor who urinated on him and sexually abused him for months

The parents of a ten-year-old boy who confessed to urinating on a boy, 7, in the toilets at a primary school have sent a callous and curt apology to the distraught mother of the boy, who also claimed he was sexually molested.
The seven-year-old, who has learning difficulties, was urinated on and sexually molested by the ten-year-old over several months at the primary school in Victoria, the mother says.
The handwritten note from the older boy's parents says: 'Dear Parent, I would like to apologise for my son's [name suppressed] inappropriate behaviour towards your child, causing you and your child distress'.
The note was written after the parents refused to meet with the mother and 'discuss the situation'.
The younger boy's mother, who cannot be identified, told Daily Mail Australia the 10-year-old boy locked her son in the toilet and urinated on him following weeks of constant bullying . The boy then told teachers that the seven-year-old had wet his pants.
The mother has decided to go public to try and force the school to expel the bully.

'I know about sexual assault on children and I fear that my son will remember this always and it will affect him as an adult. He is already showing disturbed behaviour,' the mother said.
The boy had also touched her son's penis and bottom, and forced the boy to touch his penis in the toilet and behind the school's early learning centre.
Despite the catalogue of claims, the mother claims neither the school nor the Victorian Department of Education has done anything to end the abuse, and that the department had 'threatened her' about going public.
She says she has been forced to take out an intervention order against the boy and fears she may lose the case and end up paying the legal costs incurred by other boy's parents over the action, because her son is too traumatised to give evidence in the Victorian Children's Court next year.

'He's having night terrors and he is anxious. The other day he had a meltdown. I had to take him by the arm to stop him running onto the road,' she said.
'My son is going through hell. He is petrified and has told the school he fears this other child on multiple occasions. He is only seven years old and shouldn't have to go through this.
'While I understand that this is a sensitive matter for both children and that the other child may need help too, my first concern is my son.'
She said the school had failed to stop the older boy, whose 'parents aren't poor' - and he was ignoring a a 'safety plan' put in place.
'There's also a grey area around children aged between nine and 12 years old, so the police won't lay charges,' the mother said.
The mother said she did not want to move her son because he had previously been at another school, which could not cope with his learning difficulties
The problems began earlier this year, when the mother had thought all was going well for her son, who suffers from Attention Deficit Disorder (ADHD).

'He went from not being able to read two letter words to five or six letters in one term,' she said. 'He has received so many achievement awards it's not funny.
'They are a great school that has helped him in abundance, that is very clear. The place where they have failed is in protecting him from someone they know hurts him and others.'
She said during the second school term this year, her son told her one day, "Mum I don't want to go to school because [name suppressed] will hurt me".

He then confessed that three boys had been bullying him about his slight stature and calling him names, but she had not realised the magnitude of it until the day in August when the school contacted her and said her son was 'distraught and had wet his pants'.
'When [her son] got home I spoke to him and eventually he told me "[the other boy] locked me in the toilet and he weed on me",' the mother said.
'When I contacted the school they said they hadn't known.'
The boy was punished and the school drew up a 'safety plan'. 
The mother requested a meeting with the parents of the boy, 'so we could sit down together calmly and professionally and try to work together to help the situation. But they refused to meet me'.
Under the school's safety plan the bully was 'to be supervised at all times' by a teacher and not allowed to go near her son.
But the boy continued to wage a campaign of fear against her son, escalating into sexual abuse.
Two other boys slapped the woman's son in the face in retaliation for reporting the bullying by the 10-year-old.
'In October he started having nightmares. But I didn't know why,' the mother said, breaking down and weeping at the memory.
'Then in November, my Mum was looking after him and listening him talk and she heard my son, say the words 'suck my d***'.
'My son does not use that word. He either says "penis" or "doodle" and Mum got him out of the bathroom and said "where did you hear that word?" and my son was very ashamed.
'And he said [the 10-year-old schoolboy's name] and he was keeping his head down not looking at her and then she said to him "what is a d***?" and he pointed at his penis.'
'And she told him she would have to tell me about it, but when she dropped him off it was bedtime, so the next day she called me and told me and after dinner I sat him down and said that we needed to have a little chat.
''And he put his hands over his face and put his head into the couch and said "no, no, no, I don't want to talk about it". And I asked him what a d*** was and said "has anyone ever touched you there?".
'And he started saying again "no, no, no, no".'
